On October 17, the city of Saint-Agatha-de-Monts filed a lawsuit against architectural design firm Atelier Idea and 10 other contractors responsible for renovations carried out at Le Patriote Theater.

The lawsuit filed in the Superior Court of Quebec for $3,351,600 aims to obtain compensation for additional costs incurred after modifications that were necessary to be made under the Building Code. Among the violations that had to be corrected were design problems related to the room and the safety of the building.

Given the additional costs incurred by the new work and its impact on the organization’s revenues, the city, which submitted formal notice to the designer-architect Atelier Idea last spring, decided to move to another stage of the judicial process.

Remember, the initial cost of the renovation was $3,074,000. If we add the cost related to remedial work, the total bill comes to $6,326,000. “For a small town like ours, this is unacceptable,” says Saint-Agat Mayor Frédéric Bruy.

The story begins in March 2021, when the city was notified by RBQ of a fundamental design flaw by the architectural designer that would have had a ripple effect across many other professional disciplines.

In order to shed light on the situation, the city engaged the services of consultants to identify all standard compliance issues, as well as building safety issues. After 18 months of study, many works were implemented without affecting the programming.

In this thread, he noted that the final stage of this upgrade work will be spread over the winter holidays, which may increase the cost of the claim, “With 5% interest to cover the loans, and the costs related to the professionals in the procedures, the bill rises quickly (…) We have a strong file and we are confident of The future,” said the mayor of Saint-Agathe, Frédéric Bruy.

When asked to comment on the situation, Atelier Idea representatives gave the following response: “You will understand that legal action has just been taken. The matter is in the hands of our lawyers. These are just unproven allegations. They will be contested.”
